No.2208/SL1/2007 dt 27.1.2010 and the notification of the 3rd respondent in RC No. 193/ESTT/201 dated 1.4.2010 and to quash the same as illegal.

JUDGMENT

(Judgment of the Court was delivered by M.M.SUNDRESH,J.,) When the above writ appeal is taken up for hearing, the learned counsel appearing for the appellant while seeking permission of this Court to withdraw the appeal, would submit that the appellant has got promotion on 23.10.2012 itself and has also made an endorsement to that effect.

2. In view of the same, the writ appeal stands dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is also dismissed.
