ORDER
The petitioner who was arrested on 15.05.2021 and remanded to judicial custody for the offences under Section 174(1) Cr.P.C @ 302 of IPC in Cr.No.328 of 2020 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner is the father-in-law of the deceased and that on the date of occurrence, the deceased in a drunken stage went to the house of the petitioner and had a wordy quarrel with his wife. At that time, the petitioner attacked the deceased, due to which, the deceased suffered serious injuries and was subsequently, taken to the hospital, where he was declared dead. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.
4. The learned Government Advocate (Crl. Side) vehemently opposed for grant of bail to the petitioner stating that the case was originally registered under 174 Cr.P.C. Only recently it was altered to an offence under Section 302 of IPC. Only on 15.05.2021, the https://hcservices.ecourts.gov.in/hcservices/
petitioner was arrested. The investigation is still in the initial stages. Further that, if the petitioner is released on bail, it may hamper the investigation.
