ORDER
This Writ Petition is filed to issue a Writ of Mandamus to direct the Respondent to treat the Petitioner deemed to have been promoted as selection grade senior Assistant Engineer with effect from 21.01.2008 as he put up 22 years of service as mandated by GO.Ms.No.13 Transport (C1) Department, dated 14.1.2000.
2. This court heard the learned counsel on either side and also perused the materials placed on record.
3. The Petitioner joined the service in 1982 as machine operator. The Petitioner sought for promotion, as he has not been given the same during the relevant point of time. Because of stagnation of promotion of Engineers, the Government issued GO.No.13 Transport (C1) Department, dated 14.1.2000 to give time bound promotion. However, despite his several representations, the Petitioner was denied of such https://hcservices.ecourts.gov.in/hcservices/
promotion as per the said GO. According to the Petitioner, he has already retired.
4. The learned standing counsel for the Respondent would contend that the representation of the Petitioner will be considered in the light of the said GO, as expeditiously as possible.
5. In view of the fact that the Petitioner had already retired and due promotion has not been given to him during the relevant point of time, the Respondent shall consider the representation of the Petitioner dated 13.01.2016 on merits and in accordance with law and in the light of the said GO.13 dated 14.1.2000 within a period of four weeks from the date of receipt of a copy of this order.
6. With the above directions, this Writ Petition is disposed of. No costs.
