The petitioner who was arrested and remanded to judicial custody on 07.03.2023 registered for the offence under Sections 465, 467, 468, 471, 34 and 120(b) of IPC in Crime No.44 of 2023 on the file of the respondent Police, seeks bail.

2.Trusting the petitioner, a learned Single Judge of this Court had granted interim bail to the petitioner on 20.04.2023 on condition that he shall co-operate for cancellation of various sale deeds which have been executed by him.

3.The case of the prosecution is that the father of the defacto complainant was the owner of the property along with his brother and had mortgaged the property with Punjab National Bank. The defacto complainant has redeemed the amount, but the title documents were missing. The father died in the year 1993. There was an impersonation on the father and the petitioner had purchased the property.

4.Interim bail had been granted that the petitioner who had subsequently sold the property to various persons must cancel each and every one of the document. But even when the said Calender Case is pending, the petitioner had executed yet another sale deed. https://www.mhc.tn.gov.in/judis 1/2

vkr 5.Since the petitioner has not established bonafide by cancelling the sale deeds, this Criminal Original Petition stands dismissed. The petitioner may come before this Court with a fresh petition in which, he may give a time schedule and date on which he will cancel all the sale deeds executed by him.
