The present petition has been filed to modify the condition imposed on the petitioner in Paragraph No.6 of the order dated 31.01.2023 passed by this Court in Crl.O.P.No.31433 of 2022 while granting anticipatory bail.

2. The learned counsel for the petitioner would submit that one of the conditions imposed on the petitioner is that " .... the petitioner should execute a bone for a sum of Rs.10,000/- with two sureties (one surety must be a blood related surety) " each for a like sum to the satisfaction of the respondent police... He would further submit that the petitioner is unable to execute blood sureties as his parents had already died and there is no siblings for him and now his family consists of his life partner with two minor sons. Hence, he would seek to modify the aforesaid condition.

3. Heard the learned Government Advocate (Crl. Side) appearing for the respondent police.

Taking into consideration, the facts and the submissions made by the learned counsel for the petitioner, this petition is allowed by modifying the condition to the effect that " the petitioner shall execute a bond for a sum of Rs.10,000/- with two sureties (one surety must be a close relative)". All other conditions remain intact.

5. With the above modifications, this Criminal Miscellaneous Petition is allowed.
