O R D E R

The wife, in a matrimonial proceedings, has filed the above transfer Civil Miscellaneous Petition seeking to withdraw the H.M.O.P.No.144 of 2017 pending II Additional, Sub-Court, Coimbatore and transfer the same to the file of Family Court, Chennai. The husband had filed the above H.M.O.P.No.144 of 2017 under Section 13 (i) (a) of Hindu Marriage Act for divorce.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent and perused the materials available on record.

It is stated in the affidavit filed by the petitioner that she is residing and employed at Chennai and expressed fear to attend the Court at Coimbatore where the respondent/husband and her in laws are residing. For the above said reasons, the petitioner has expressed her difficulty to attend the hearing of the above H.M.O.P. pending before the II Additional, Sub Court, Coimbatore.

4. The learned counsel appearing for the respondent/husband has got no serious objection for the said transfer. https://hcservices.ecourts.gov.in/hcservices/

Considering the submission made by the learned counsel for the petitioner and as the respondent has got no objection in transferring the petition to the Family Court, Coimbatore, this Tr.C.M.P is allowed and H.M.O.P.No.144 of 2017, pending on the file of the II Additional, Sub Court, Coimbatore shall stand withdrawn and transferred to the file of Family Court, Chennai.
