ORDER

By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

2. This petition has been filed for a direction, directing the respondent to pay Rs.1,49,27,000/- to the petitioner towards the completed part of construction at Survey No.2893 and 2894 at Kakithapattari, Arcot Road, Vellore by considering the representation of the petitioner dated 10.12.2025.

3. It is the case of the petitioner that the petitioner is a contractor was awarded a contract to build the shopping complex comprising of 24 shops at S.Nos.2893 & 2894 with an extent of 40094 Sq.ft., at Kakithapattari, Arcot Road, Vellore belonging to the respondent. An agreement was entered into between the petitioner and the respondent to that effect and the construction of ground floor was completed and an amount of Rs.1,49,27,000/- was certified by the Assistant Engineer and Assistant Executive Engineer and Executive Engineer of HR & CE Department dated 08.12.2025. It is the grievance of the petitioner, that amount is not disbursed to the petitioner, hence, the petitioner made representations on 10.12.2025 and 13.01.2026 which is pending without consideration. Hence, this writ petition.

The learned counsel for the petitioner submitted that after filing of the writ petition, the respondent has sent a communication to the petitioner stating that the first respondent has sent a request to the Arulmighu Arunachaleswarar Temple, Joint Commissioner 30.01.2026 for loan disbursement and after receipt of the amount, the payment will be made to the petitioner within a reasonable time as fixed by this Court.

5. Heard both sides and perused the materials placed on record.

6. Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the respondent to disburse the payment to the petitioner as indicated in its reply to the petitioner dated 24.03.2026 within a period of twelve weeks from the date of receipt of a copy of this Order.
