Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of MANDAMUS, directing the respondents to consider the claim of the petitioner for promotion as Grade-I Warder for the panel year 2016-17 and promote him as Grade-I Warder and grant him all consequential service and monetary benefits and grant such other further relief.

O R D E R

The learned counsel represents that disciplinary proceedings initiated against the writ petitioner was disposed of and no disciplinary proceedings are pending against him. Therefore, the writ petitioner is eligible for promotion to the post of Grade-I Warder.

2. In this regard, the Prisons Superintendent has forwarded the representation submitted by the writ petitioner to the first respondent. But no decision is taken with regard to https://hcservices.ecourts.gov.in/hcservices/

the right of the promotion to the petitioner. The learned counsel further states that there is no other disciplinary proceedings are pending against the petitioner and he is fully qualified for the promotion. In such view of the matter, the second respondent is directed to consider the representation submitted by the writ petitioner on 11.01.2017 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

3. Accordingly, the writ petition stands disposed of. No costs.
