The petitioner has filed this petition to direct the fourth respondent to restore the said Community hall to these people for the said purposes as to be disposed the representation dated 30.07.2024.
2. The case of the petitioner is that the petitioner, who is the Secretary of Dr.Ambedkar Memorial Welfare Development Trust, has filed this writ petition seeking restoration and allotment of a Community Hall at Pudupet, Virudhachalam, originally gifted by Late Thiru.V.P.Vedamanickam, ExMLA, to the Adi Dravidar Welfare Department for the benefit of economically weaker Adi Dravidar People to conduct marriages and religious functions. Though the hall was built and inaugurated in 1963, it was later occupied by the Town Panchayat for running a school, depriving the community of its intended use. Despite multiple representations, RTI Page No.2 of 6
applications, and directions from various authorities, no action was taken, and instead, the fourth respondent unlawfully demolished the hall and began new construction, prompting the petitioner to file this writ petition.
3. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice if this Court issues direction to the fourth respondent to consider the petitioner's representation dated 30.07.2024 on merits, in accordance with law and pass appropriate orders within a time frame to be fixed by this Court.
4. Learned Government Advocate appearing for the respondents has no objection for the said order being passed by this Court.
5. Heard the learned counsel on either side and perused the materials available on record.
6. Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case directs the fourth respondent to consider the petitioner's representation dated Page No.3 of 6
30.07.2024, after giving due notice to the petitioner, affording an opportunity of personal hearing and considering the documents filed by the petitioner on merits, in accordance with law and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.
7. This writ petition is disposed of with the aforesaid observation and directions. No costs.
