Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.A.No.179 of 2020 on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on the petitioner by the II Additional Sessions Judge at Chennai, dated 25.07.2019 in S.C.No.5 of 2011 u/s.147, 341, r/w 149 and 302 r/w 149 of IPC and release the petitioner on bail pending of the above Crl.A.No.179/2020.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.No.179 of 2020 on the file of the High Court and upon hearing the arguments of M/S.R.SIVARAMAN, Advocate for the petitioner and of M/S.R.MUNIYAPPARAJ, Govt. Advocate (Crl side) on behalf of the Respondent the court made the following order:- (Order of the Court was made by P.N.PRAKASH, J.) This criminal miscellaneous petition has been filed seeking to grant suspension of sentence imposed on the petitioner by judgment and order

dated 25.07.2019 passed in S.C.No.5 of 2011 on the file of the II Additional Sessions Court, Chennai and to enlarge the petitioner on bail pending disposal of the above appeal.

2. It is seen that there are many previous cases pending against the petitioner and one such case pending in P.R.C.No.94 of 2009 for the offences under Sections 307 and 392 IPC.

3. In such view of the matter, this is not a fit case to grant suspension of sentence and bail to the petitioner at this stage and hence, this criminal miscellaneous petition is dismissed for the present. The Registry is directed to call for the records, prepare the typed set of papers and post the main appeal for hearing in the second week of August.
