PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to dispose off the appeal filed by the petitioner dated 25.9.2014 within a time frame fixed by this Court.

For Petitioner : Mr.T.Jeevanantham For Respondent-1 : Mr.V.Vijaya Shankar ORDER OF THE COURT WAS MADE BY V.RAMASUBRAMANIAN,J The petitioner, who is employed as an Office Assistant in the Court of the Principal District Judge, has come up with the above writ petition, seeking a limited prayer to direct the first respondent to dispose of his appeal.

2. Heard Mr.T.Jeevanantham, learned counsel for the petitioner. Mr.V. Vijaya Shankar, learned counsel takes notice for the first respondent.

3. The petitioner was placed under suspension and a charge memo was issued to him on 9.4.2012. Pursuant to disciplinary proceedings, he was dismissed from service by an order dated 5.12.2012.

4. As against the order of dismissal, the petitioner filed a review application. The Principal District Judge, Namakkal is said to have originally granted reinstatement and thereafter ordered stay of the order of reinstatement. As against the said order, the petitioner came up with a writ petition in W.P.No.6074 of 2013. It was disposed https://hcservices.ecourts.gov.in/hcservices/

of by this Court with liberty to the petitioner to file an appeal as against the original order of dismissal. Accordingly, the petitioner filed a statutory appeal and the same is now pending with the first respondent. Therefore, he seeks a limited direction to the first respondent to dispose of the appeal.

5. Considering the above, the writ petition is disposed of directing the first respondent to consider and pass appropriate orders in accordance with law on the appeal filed by the petitioner, within a period of three months from the date of receipt of a copy of this order. No costs.
