Srividhya @ Kurella Srividhya v. V.Suryakala

2023-04-27Honourable Ms Justice R.N.Manjula3 pages

in C.S. No.563 of 2019 R.N.MANJULA, J.

This application is filed to receive additional documents on the side of the plaintiff.

2. The documents sought to be produced is a certificate dated 03.04.2023 given by one R.Surendran stating that the plaintiff was the only attendant of the patient by name Vivek Vijayakumar. The said Vivek Vijayakumar is the testator of the disputed Will involved in this proceedings.

3. The learned counsel for the respondent objected that the applicant is in the habit of filing similar applications each and every time and delay the proceedings.

4. However the learned counsel for the applicant submitted that in the earlier application filed to receive the additional documents, there was a typographical error committed from the side of the hospital in mentioning the name of the patient. Instead of naming the patient as Vivek 1/3

Vijayakumar, it is mentioned as K.Srividhya.

5. The submission of the applicant shows that she happened to be with her husband who was ill and admitted in the hospital at the relevant point of time. Since the applicant has filed this petition only in view of the error that is said to have occurred in the earlier certificate given by the Doctor, I feel that this application can be considered in the interest of justice however, subject to proof and relevancy.

6. Accordingly, this application is allowed.
