The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 417, 376(2)(n) and 312 of IPC in Crime No.2 of 2024, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant studying Aurobindo College of Education in B.Ed. A1 called the defacto complainant over phone and wished her for new year and then he frequently called her, sent text messages ad proposed her. Thereafter the defacto complainant started loving A1. A1 promised to marry the defacto complainant with the consent of his parents. Based on the promise he had a sexual intercourse with the defacto complainant several time, as a result of which she became pregnant and thereafter he refused to marry her. A2 gave her the abortion pills. Hence the complaint.
3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. The petitioners have nothing to do with this case. A2 is the sole breadwinner of the 1/5
family. If this anticipatory bail application is not allowed, the petitioners will be put to irreparable loss and hardship. They are permanent resident in the above said address and the petitioners will not abscond or flee justice if released on bail. They are willing to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent vehemently opposed to grant anticipatory bail to the petitioners. 5.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.side) for the respondent and perused the entire materials available on record.
6.Taking into consideration the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl.Side) and considering the gravity of the offence and also taking note of the fact that the case is at initial stage and it needs detailed investigation. Hence, this Court is not inclined to grant anticipatory bail to the petitioners. 2/5
