This petition has been filed to condone the delay of 930 days in preferring the second appeal.

Though the 4th respondent's name is appeared in the cause list, there is no representation on behalf of her.

Heard the learned counsel for the petitioner and the learned counsel for the respondents 1 and 2.

It is seen from the affidavit and the additional affidavit filed in support of the petition that the judgment and decree in the first appeal was delivered on 03.06.2019 and the copy application was filed on 04.06.2019 and the certified copy of the judgment and decree was made ready on 17.07.2019.

It is also stated by the petitioner that at the relevant point of time, she was suffering from health issues and was also burdened with domestic responsibilities. Thereafter, there was an outbreak of Covid-19 restraining the movement, and ultimately the second appeal was filed on 29.04.2022 with a delay of 930 days. Being satisfied with the reasons assigned in the affidavit filed in support of the petition, the delay of 930 days in preferring the second appeal is condoned. Registry is directed to number the second appeal, if it is otherwise in order and list the same for admission.
