This petition has been filed to modify the condition imposed in Paragraph No.8(b) in Crl.O.P.No.6940 of 2023 by an order dated 28.03.2023.

2. The learned counsel for the petitioner submitted that this Court, by an order dated 28.03.2023, had granted bail to the petitioner in Crl.O.P.No.6940 of 2023 with a condition to deposit a sum of Rs.2,00,000/- to the credit of Crime No.22 of 2023 as ex gratia payment, out of which, Rs.1,75,000/- to the father of the deceased and Rs.25,000/- to the injured/victim. He further submitted that the petitioner is a poor man and the family members of the petitioners are unable to mobilize the huge amount and they have arranged only a sum of Rs.60,000/-. He also submitted that despite the bail order being granted on 28.03.2023, the petitioner is unable to come out on bail and still, the petitioner is languishing in prison, thereby, he seeks for modification of the condition.

3. Learned Government Advocate (Crl.Side) submitted that the petitioner has been granted bail on 28.03.2023.

4. Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side, this Court is inclined to modify the Condition in Para 8(b), which shall be read as follows:- Page No.1/2 https://www.mhc.tn.gov.in/judis

vkr " 8(b). the petitioner shall deposit a sum of Rs.60,000/- (Rupees Sixty Thousand only) to the credit of Crime No.22 of 2023 as ex gratia payment, out of which, Rs.50,000/- shall be paid to the father of the deceased and Rs.10,000/- shall be paid to the injured/victim after issuance of notice and verification." The other conditions imposed by this Court in Crl.O.P.No.6940 of 2023 on 28.03.2023 shall remain unaltered.

5. With the above directions, this Criminal Miscellaneous Petition stands ordered.
