Comp.A.No.196 of 2019 and C.P.No.271 of 2016 N.SATHISH KUMAR, J.

This application has been filed to recall the order dated 11.01.2018 in C.P.No.271 of 2016.

2. The learned counsel for the petitioner submitted that even in other petitions, the learned Official Liquidator has filed counters despite the company has been closed only on the ground that certain copies have been taken for scrutiny. Further it is the contention of the petitioner that since the official liquidator is incharge of the company, he seeks to recall the order passed by this Court.

3. The learned Official Liquidator submitted that since company petition is closed he cannot do anything unless the company petition is restored and they cannot take incharge of the company. However, the Official Liquidator submits that he has no objection for recalling the order.

4. In view of the above, the order passed by this Court dated 11.01.2018 is hereby recalled and the learned Official Liquidator shall take incharge of the company and file a report before this Court.
