This Transfer Civil Miscellaneous petition is filed by the petitioner/husband in the matrimonial dispute seeking to withdraw H.M.O.P.No.145 of 2017, pending on the file of District Family Court, Dindugal and transfer the same to any of the Family Courts in Chennai or Chengalpet.
2. H.M.O.P.No.145 of 2017 was filed by the respondent/wife under Section 13(1)(ia) of the Hindu Marriage Act, before the District Family Court, Dindugal for dissolution of marriage held between the petitioner and respondent on 09.05.2016.
3. Heard the learned counsel for the petitioner and the learned counsel for the respondent.
4. It is stated in the affidavit filed in support of the petition that the respondent/wife is living in Hyderabad. It is also stated that the parties have arrived at a settlement and https://hcservices.ecourts.gov.in/hcservices/
proposed to file a petition under Section 13B of the Hindu Marriage Act.
5. The learned counsel appearing for the respondent/wife has got no objection for transferring the H.M.O.P.No.145 of 2017 from the file of District Family Court, Dindugal to any of the Family Courts in Chennai. In view of the no objection expressed by the learned counsel, the petition is ordered as prayed for.
6. Accordingly, the Transfer Civil Miscellaneous Petition is allowed by withdrawing H.M.O.P.No.145 of 2017, pending on the file of District Family Court, Dindugal and transferring the same to any of the Family Courts in Chennai.
