Defendants PRAYER: Plaint filed under Order IV Rule 1 of the Original Side Rules 1956 read with Order VII Rule 1 of Code of Civil Procedure praying to pass the following judgment and decree against the defendants:- (a) for a permanent injunction restraining the 1st defendant, his men, servants and his representatives from interfering, disturbing or from preventing the smooth release of the film "MUDINJA IVANE PUDI" (Tamil - Col.) as per the Censor Certificate No.23323 of 2016 dated 04.08.
2016 issued by the Regional Censor Board, Chennai, in the entire State of Tamil Nadu, either directly or indirectly by misusing his position as the Secretary of the Distributors' Federation / Circle, under the South Indian Film Chamber of Commerce, without any sanctity in the eye of law. (b) for a permanent injunction restraining the 1st defendant from giving / issuing any instructions or directions either directly or indirectly and orally or in writing, to the Distributors and to the exhibitors in the State of Tamil Nadu, with a view to stall and prevent the smooth release of the plaintiff's film "MUDINJA IVANE PUDI" (Tamil - Col.) scheduled to be released on 12.08.2016 in the State of Tamil Nadu.
(c) for directing the 1st defendant to pay costs of the suit to the plaintiff. For Plaintiff : Mr.R.Shanmugam
J U D G M E N T
Learned counsel appearing for the plaintiff seeks permission of this Court to withdraw the present suit and he has also made an endorsement to that effect in the Court bundle.
2. Recording the same, the Civil Suit is dismissed as withdrawn. There shall be no order as to costs. Consequently, connected original applications are closed. Registry is directed to refund the Court Fee, if it is permissible, in accordance with law. 19.09.2018 TK M.GOVINDARAJ, J.
