O R D E R

The present writ petition has been filed to quash the communication dated 12.04.2010 sent by the second respondent, thereby rejecting the claim of the petitioner seeking exemption from payment of Entry Tax. A consequential direction has also been sought for by the petitioner to the respondents 2 and 3 to refund the entry tax, if any collected and register the hydraulic mobile crane bearing Chassis No.1359723822 and Engine No.S433 - A18817 respectively.

2.However, when the matter was taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that it would suffice, if the petitioner is given liberty to approach the authority concerned with a fresh representation to get their property in question registered, for which, the learned Additional Government Pleader appearing for the respondents has no serious objection.

3.Granting such liberty to the petitioner, this writ petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
