C.M.P.No.9585 of 2019 in O.S.A.No.187 of 2014 R.SUBBIAH, J and KRISHNAN RAMASAMY, J [Order was delivered by KRISHNAN RAMASAMY, J] This Civil Miscellaneous Petition has been filed seeking modification in the order passed in O.S.A.No.187 of 2014 dated 26.02.2019.

2. Heard the learned counsel for the petitioner/appellant and the learned counsel for the respondent.

Learned counsel for the petitioner/appellant submits that this Court, under orders in O.S.A.No.187 of 2014 dated 26.02.2019, directed the appellant to publish in one issue of Tamil Daily 'Maalaimalar' and in one issue of English Daily 'Business Time' and in the Tamil Nadu Government Gazette fixing the date of hearing of Company Petition No.41 of 2012 on 24.04.2019. The publication is to be effected 14 days prior to the date of hearing. However, due to oversight, the publication has not been effected as directed by this Court. Hence, the present petition has been filed. http://www.judis.nic.in

Considering the submissions made and satisfied with the reasons assigned in the affidavit filed in support of the petition, this Court is inclined to re-fix the date of hearing of the Company Petition No.41 of 2012. Accordingly, the appellant is directed to publish in one issue of Tamil Daily 'Maalaimalar' and in one issue of English Daily 'Business Time' and in the Tamil Nadu Government Gazette fixing the date of hearing of Company Petition No.41 of 2012 on 24.06.2019 instead of 24.04.2019. In all other aspects, the earlier order remains unaltered.
