These petitions are filed (i) to condone the delay of 257 days in filing the petition to set-aside the order of abatement caused due to the death of the fifth appellant (ii) to set-aside the order of the abatement caused due to the death of the fifth appellant (iii) to bring on record the legal heirs of the deceased fifth appellant in the above Second Appeal.
2. Mr.B.Kumarasamy, learned counsel appearing for the first respondent and Mr.V.Nicholas learned counsel appearing for the second respondent did not raise serious objection in allowing these petitions.
3. Having satisfied with the reasons assigned in the affidavit filed in support of these petitions, these petitions are allowed.
