ORDER

The petitioner apprehends arrest for the alleged offence under Sections 326, 303(2) of BNS and under Section 21(5) of Mines and Minerals

(Development and Regulation) Act 1957, in Crime No.315 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found to be transporting 1.5 unit of river sand without any valid permission. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and has been falsely implicated in this case. The petitioner is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are one case pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioners.

5. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the very factum that the petitioner has criminal antecedents and it discloses that he misused the liberty granted by this Court. Hence, this Court is of a firm view that the petitioner does not deserve anticipatory bail. Hence, this Criminal Original Petition is dismissed. 02-04-2026 DRL
