By consent, the main writ petition is taken up for final hearing. 2.
The petitioner claims to be the Trustee of Muthu Mariamman Kovil, Thamlerimuthur Village and according to him, every year during the month of July, they used to conduct Temple festival and for this year also an application dated 05-07-2015 is submitted to the respondent praying for permission to conduct cultural program on 1707-2015, the said application was rejected, vide impugned order dated 06-07-2015 stating that without orders of this Court, such permission cannot be granted and challenging the legality of the same, the petitioner has filed this writ petition.

The learned counsel for the petitioner, on instructions, would submit that in the event of permission being granted to the petitioner to conduct the cultural event, which includes song and dance, no vulgarity or obscenity will be in place. https://hcservices.ecourts.gov.in/hcservices/

This Court, heard the submissions of Mr.V.Subbiah, learned Special Government Pleader. The impugned order merely refers to the fact that in case of non-issuance of permission/direction granted by this Court, no festival can be conducted.

The learned counsel for the petitioner, on instructions, has also given an undertaking with regard to the conduct of the cultural program, without any law and order problem or obscenity or vulgarity. Therefore, in the light of the facts and circumstances of the case, the writ petition is partly allowed and the impugned order dated 06-07-2015 is set aside. The matter is once again remanded to the respondents for consideration and adjudication. The respondent is directed to consider the representation and pass orders on or before, 15-07-2015 and communicate the decision to the petitioner. 6.
No costs. Consequently, the miscellaneous petition is closed.
