O R D E R

The petitioner has filed the above Writ Petition to issue a writ of mandamus directing the 4th respondent to assign case number and conduct an enquiry on the Second appeal presented by him on 03.07.2017 under Section 19(3) of Right to Information Act of 2005 which was received by the 4th respondent on 05.07.2017 and furnish the information as sought for, within a time frame.

2. The learned counsel appearing for the petitioner submitted that though the petitioner has filed the Second Appeal as early as on 03.07.2017, the 4th respondent has not assigned the case number and taken up the matter for enquiry.

3. Mr.M.Ranjan Rajagopal, learned counsel appearing for the respondents submitted that the 4th respondent has already assigned the case number and therefore, the 4th respondent may be directed to dispose of the second appeal preferred by the petitioner within six months time.

4. In view of the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the 4th respondent to dispose of the Second Appeal No.5124 of 2017, on merits and in accordance with law, within a period of six months from the date of receipt of a copy of this order. With this observation, the Writ Petition is disposed of. No costs. 18.09.2017 Index:Yes/No sk
