O R D E R

The petitioners are the residents of Irudhai Village, Thirunavalur Panchayat Union. They are approaching this Court for a mandamus, directing the Official respondents to take action against the respondents 6 to 8, being the President, Vice-President of the Village and the wife of the Vice- President.

2.It is the case of the petitioners that the 7th & 8th respondents eventhough the Vice-President and his wife, are also enrolled as beneficiaries under the MGNREGA scheme and amounts have been paid even without working and there has been misappropriation of funds. Not only the Vice-President and his wife, there are also several bogus entries in the new MGNREGA scheme which included the persons who are not residing in the Village also.

3.When a complaint has been given, the 1st respondent as an Inspector of Panchayat ought to have taken action on the same. 2/4

When the matter came up for hearing, the learned Government Advocate appearing on behalf of the respondents would submit that already the complaint is being looked into and the names of the Vice-President and his wife has been removed from the rolls of MGNREGA scheme. Further, an audit is directed to be conducted and depending on the result of the audit, further action will be taken in accordance with the provisions of the Tamil Nadu Panchayat Act.
