.... Respondents PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the respondents for their willful disobedience and deliberate violation in complying the order dated 07.12.2023 passed by this Court in W.P.No.33822 of 2023.

In this petition, the petitioner alleges contempt of the directions under order dated 07.12.2023. In the Writ Petition, the prayer was for a mandamus forbearing the respondents from collecting any charges/arrears until the Pg.No.2/4

outstanding dues of Rs.50,00,000/-, payable with interest towards refundable security deposit is credited in the accounts of the petitioner.

2. Mr.Aravind, learned counsel for the respondents circulates a copy of e-mail dated 29.04.2024 from the office of the Assistant Electrical Engineer, Solar Non-conventional Energy Sources (R2) to the effect that the amount available in the security deposit will be adjusted from further bills for the reason that the bills raised so far have been settled by the petitioner.

3. Learned counsel for the petitioner emphasizes contempt on the ground that post passing of order dated 07.12.2023, a legal notice has been issued on 13.02.2024 seeking adjustment of the bills raised.

4. Contempt is evident on the face of the records insofar as there is also an acknowledgement for receipt of legal notice dated 13.02.2024. However, in light of the assurance now made by R2, the respondents are let off with a warning and directed to ensure compliance with order dated 07.12.2023.
