This Criminal Original Petition has been filed to direct the respondent herein to register a case on the complaint of the petitioner dated 19.12.2014 and investigate the same.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

3. It is seen that this petition enquiry has been pending since 2014.

Earlier Ammanullah (proposed accused) filed Crl.OP.No.12310 of 2015 before this Court and this Court had directed the respondent Police to complete the enquiry within a period of eight weeks. Since only a petition enquiry was pending, no regular order of Anticipatory Bail was granted by this Court. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Additional Public Prosecutor submits that, the said Ammanullah appeared before the Police on 04.06.2015 and gave an undertaking that he will return the money to the petitioner within one year. The learned Additional Public Prosecutor also submits that there are other complaints against this Ammanullah.

5. Under such circumstances, the respondent Police is directed to expeditiously complete the enquiry and if a prima facie case is made out against Ammanullah, a regular case may be registered against him, irrespective of his undertaking and action shall be taken in accordance with law.
