ORDER

This Criminal Original Petition has been filed to grant special leave to prosecute the respondent against the judgment of acquittal dated 11.02.2021 passed in STC No.42 of 2020 on the file of the learned Judicial Magistrate, Fast Track Court, Attur, Salem.

2. Learned counsel for the petitioner submitted that the petitioner has filed the complaint against the respondent before the learned Judicial Magistrate Fast Track Court, Attur, Salem in STC No.42 of 2020, for the offence under Section 138 of the Negotiable Instruments Act. The learned Magistrate vide order dated 11.02.2021, acquitted the respondent/accused. Aggrieved over the same, the petitioner has filed the criminal original petition seeking leave to file an appeal.

3. Heard the learned counsel for the petitioner and perused the grounds of appeal.

4. Since there are arguable points in the grounds of appeal, leave is granted.
