PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, directing the 1st and 2nd respondents to give adequate police protection to the petitioner, 3rd and 4th respondents while conducting the survey and demarcation of the lands owned by the petitioner admeasuring an extent of 2 acres comprised in S.No.543/3B3A situated at Naraanapuram Village, Palladam Taluk, Palladam Sub-Registration District, For Petitioner : Mr.T.Sai Krishnan For Respondents : Mr.E.Raj Thilak Additional Public Prosecutor **********
ORDER
This Writ Petition has been filed for Writ of Mandamus, directing the respondents 1 and 2 to give police protection to the petitioner while conducting the survey and demarcation of the lands owned by the petitioner admeasuring an extent of 2 acres comprised in S.No.543/2B3A situated at Naraanapuram Village, Palladam Taluk, Palladam Sub-Registration District, 2.The learned counsel appearing for the petitioner would submit that the respondents 5 to 8 are interfering in his possession and attempting to encroach upon the lands, which belongs to him. Regarding the same, the 2/5
petitioner had given a representation to the respondents 1 and 2. However, no action has been taken by the respondents 1 to 2. 3.The learned Additional Public Prosecutor would submit that the petitioner's representation has not been received by the respondents 1 and 2 and if the petitioner give a fresh representation, the respondents 1 and 2 would consider the same and pass appropriate orders in accordance with law.
4.The prayer in the Writ Petition cannot be granted without hearing the respondents 5 to 8. Hence, the petitioner is therefore, directed to give a fresh representation to the 2nd respondent in person. On receipt of such representation, the 2nd respondent shall call all the parties concerned, including respondents 5 to 8 and after hearing all the parties, the 2nd respondent shall take appropriate action in accordance with law.
