Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, to direct the respondents to cancel the patta which was wrongly entered in S.No.585/17, 585/18 and 584/3 in the UDR scheme and consequently issue the patta in the name of the petitioner based on the petitioner's representation dated 22.06.2020. O R D E R
This writ petition has been filed for an issue of writ of mandamus, directing the respondents to carryout the necessary correction in the revenue records and issue patta in the name of the petitioner on the representation made by the petitioner on 22.06.2020.
2. The case of the petitioner is that the property in question is an ancestral property and the petitioner is entitled to the property by virtue of a settlement deed. According to the petitioner a wrong entry was made at the time of carrying out the UDR scheme. The petitioner approached the respondent by making a representation to delete the wrong entry in the revenue records and to issue patta in the name of the petitioner. After the representation was made by the petitioner, the District Collector by his communication dated 26.09.2019 directed the third respondent to immediately act upon the representation made by the petitioner and pass appropriate orders. The grievance of the petitioner is that the third respondent has neither acted upon the representation made by the petitioner nor the direction issued by the first respondent. Aggrieved by the same the present writ petition has been filed before this Court seeking for appropriate directions.
2. Heard Mr.M.Rajendiran, learned counsel appearing for the petitioner and Mr.Aruldoss, learned counsel appearing on behalf of the respondents.
3.Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the third respondent to act upon the representation made by the petitioner on 10.06.2019 and 22.06.2020 and deal with it strictly in accordance with law and pass appropriate order within a period of eight weeks from the date of receipt of a copy of this order. If the third respondent feels that notice should be issued to any other interested parties, the same shall be done before conducting the enquiry and passing orders. The petitioner is directed to make a fresh representation along with all relevant documents and also a copy of this order.
6. This writ petition is disposed of with the above direction. No cost.
