ORDER
This petition has been filed seeking a direction to the second respondent to complete the investigation and file the final report in Crime No.62 of 2014.
2. Learned counsel for the petitioner submits that on the petitioner's complaint, a case has been registered in crime No.62 of 2014 for offence under section 120(B), 409, 417, 420, 423, 467, 471 & 506(i) of IPC r/w Section 82(d) of Registration Act. Except for registering the FIR, there is no further progress and hence, this petition has been filed.
3. Learned Additional Public Prosecutor has produced a copy of the final report in RCS.No.6 of 2022 on 25.10.2022.
4. Learned counsel for the petitioner submits that on coming to know of filing of final report, the petitioner had filed a protest petition on 03.03.2023, but the same has been returned on 21.03.2023 with an endorsement, "till now the charge sheet not filed". The petitioner had produced the returned copy of the protest petition.
5. Learned Additional Public Prosecutor today produced the closure report and submits that through post, the closure report had been intimated to the petitioner and the same has been received by the petitioner on 10.04.2026.
6. In view of the same, it is clear that though the further action dropped in RCS No.6 of 2022, it has been informed to the petitioner only on 10.04.2026.
Now it is for the petitioner to file a protest petition before the Judicial Magistrate-3, Tiruppur. Thereafter, the learned Judicial Magistrate-3, Tiruppur shall consider the case on merits.
