Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order dated 17.03.2023 issued by the 2nd respondent and to quash the same and consequently direct the 2nd respondent to issue patta in favour of the petitioner in respect of the land comprised in S.No.193/8 measuring to an extent of 78 square feet of land classified as Nanjai Tharisu situated at Harur Town and Taluk, Dharmapuri District.

(Order of the Court was made by C.SARAVANAN, J.) This writ petition has been filed challenging the impugned order dated 17.03.2023 issued by the 2nd respondent Tahsildar and to consequently direct the 2nd respondent to issue patta in favour of the petitioner.

2. The petitioner has an alternative remedy before the District Collector / 1st respondent and without availing the said remedy, the petitioner has directly approached this Court. We do not find any merits in the present writ petition and the same is dismissed. No costs.

3. However, it is made clear the 2nd respondent shall independently consider the request made by the petitioner for grant of patta on merits and in accordance with law and pass appropriate orders thereon within a period of six weeks from the date of receipt of a copy of this order. Status quo as on today shall be maintained until the disposal of the appeal to be filed by the petitioner before the 1st respondent, and no coercive steps shall be taken by the respondents till then.
