This application has been filed seeking leave to file the above suit for partition and separate possession with respect to Item Nos.1 to 5 of the B schedule which are situated outside the jurisdiction of this Court and also against the respondents / defendants 9,12 to 14 and 16 to 22 who are residing outside the jurisdiction of this Court.

2. According to the learned counsel for the applicants / plaintiffs, the suit has been filed for partition and separate possession with respect to the schedule mentioned properties. Even though the cause of action is well within the jurisdiction of this Court, five items of Schedule B of the suit schedule mentioned properties are situated outside the jurisdiction of this Court and some of the defendants are residing outside the jurisdiction of this Court. Hence, this leave application is filed.

3. Considering the submission made by the learned counsel for the

applicants / plaintiffs and considering the averments made in this C.V.KARTHIKEYAN,J.

gsk application as well as the plaint, leave is granted. Registry to number the plaint if it is otherwise in order.
