Civil Revision Petition filed under Article 227 of the Constitution of India, against the proceedings of rent controller in not disposing of the application in HRCOP.No.5 of 2007, on the file of the District Munsiff, Tirupattur, Vellore District for over five years.

O R D E R

This civil revision petition has been filed seeking direction to the District Munsiff, Tirupattur to dispose of the HRCOP.No.5 of 2007, which is pending for more than five years i.e. almost crossing 100 hearings. The learned Judge has not completed the trial.

2.It is unfortunate that the trial Court time and again, even after direction from this Court asking the trial Court to dispose of the case at the earlier stage has failed to do so. The case in hand clearly seen from the extract shows the nearly after 100 hearings, the case was adjourned for the past 5 years and the civil revision petition has been filed in the year 2012. Even, after filing the civil revision petition, 4 years have gone by the HRCOP filed in the year 2007, is still pending without any further progress.

3.Therefore, the learned District Munsif, Tirupattur is https://hcservices.ecourts.gov.in/hcservices/

hereby directed to dispose of the above case in HRCOP.No.5 of 2007 within a period of one month from the date of receipt of a copy of this order by conducting trial on a day to day basis and pass final orders. Both parties are hereby directed to cooperate for the early disposal of the said case without getting any adjournment.

4.Accordingly, the civil revision petition is disposed of. No costs.
