5.It is also submitted that due notice has been served on the fourth respondent on 28 January 2016. However, no action could be taken on account of pendency of this petition. The reason of not taking action on account of pendency of the writ petition is misconceived. There is no stay or injunction by the Court from proceeding with the notice. However, having regard to the facts situation and also the factum of giving an undertaking earlier in W.P.No.24891 of 2014 by the fourth respondent, we grant further two weeks` time to the fourth respondent to remove the unauthorised construction on his own, failing which, respondents 1 to 3 are directed to remove the unauthorised construction and submit a compliance report before this Court. 6.With the aforestated observation and direction, the writ petition stands disposed of. No costs.
Post the matter on 20.04.2016 for reporting compliance. 2.The matter is listed today `for reporting compliance`. No compliance report has been filed. Let the Member Secretary, Karaikal Planning Authority, Karaikal, Puducherry remain present before this Court on 02.06.2016 to explain as to why contempt proceedings be not initiated against him.
