This Civil Miscellaneous Petition has been filed to set aside the order of the dismissal dated 28.04.2016 passed in the above Appeal and restore the appeal on file.

2. The learned counsel for the respondents has no objection in allowing this petition.

3. In view of no objection submitted by the learned counsel for the respondents and being satisfied with the reasons stated in the affidavit filed in support of this petition, this Petition is allowed and C.M.A.No.2310 of 2013 is restored to file.

4. The Registry is directed to post the appeal on 16.06.2023.
