This matter is posted today before this Court under the caption "For Being Mentioned" at the instance of the learned Standing Counsel appearing for the respondents 1 & 2 / Tamil Nadu Slum Clearance Board.

2. The learned counsel for the petitioner as well as the learned Additional Advocate General appearing for the Respondents 1 & 2 / Tamil Nadu Slum Clearance Board are present.

3.Mr.Kumaresan, Additional Advocate General appearing for the Tamil Nadu Slum Clearance Board would submit that this Court, by an order dated 12.08.2021 passed in W.P No.12372 of 2021 directed the respondents to consider and dispose of the representation of the petitioner dated 29.01.2021 on merits and in accordance with law, within a period of eight weeks from the date of receipt of order copy. He would further submit that since the Model Code of Conduct came into force, all the Superintending Engineers and Executive Engineers were instructed to stop the interview process immediately w.e.f 26.02.2021 and was kept in abeyance. Hence, interview was not conducted due to the Model Code of Conduct followed by the lockdown announced by the Government due to Covid-19 pandemic situation, therefore, the entire process of

recruitment has been cancelled due to the reasons stated supra. He would further submit that the petitioner is at liberty to apply for the post of Office Assistant at the time of fresh recruitment/another notification. But, this Court, in paragraph 4 & 5 of the earlier order dated 12.08.2021, has held as follows:

4.This Court considering the limited prayer sought for in this Writ Petition, Without going into the merits of the case, the respondents are directed to consider and dispose of the representation of the petitioner dated 29.01.2021, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition is disposed of. No costs.

Hence, he prays to recall para 4 & 5 of the earlier order passed in W.P No.12372 of 2021 on 12.08.2021.

Considering the submissions made by the learned Additional Advocate General that the interview was not conducted due to the Model Code of Conduct followed by the lockdown announced by the Government due to Covid-19 pandemic situation, and the entire process of recruitment has been cancelled, this Court is not inclined to allow this writ petition and the earlier order passed by this Court in W.P No.12372 of 2021 on 12.08.2021 is recalled. However, it is open to the writ petitioner to apply for the post of

Office Assistant at the time of fresh recruitment/another notification.

5. With the above observation, this Writ Petition is disposed of. No costs. 09.12.2021 uma Note: Registry is directed to issue a fresh order copy.
