ORDER
This criminal original petition has been filed to call for the entire records relating to the First Information Report in Crime No.362 of 2015 on the file of the 1st respondent and quash the same.
2.Heard the learned counsel appearing for the petitioner, the learned Additional Public Prosecutor appearing for the first respondent and the learned counsel appearing for the second respondent.
3. On a complaint lodged by one A.Sathyamoorthy, the first respondent police have registered a case in Crime No.362 of 2015 on 29.10.2015 for offences under Sections 294(b), 427 & 506(i) IPC against R.Chakkaravarthy, challenging which, R.Chakkaravarthy is before this Court for quashing the prosecution on the ground that both the parties have arrived at a compromise. 4.Today, The first respondent / Mr.V.Mani, SSI, B-7, Vellavedu Police Station, Thiruvallur District, is present before this Court and he identified the parties and R.Chakkaravarthy/Petitioner and A.Sathyamurthy, second respondent/Defacto complainant are also present before this Court and they have filed a joint compromise memo, wherein, it is stated as follows; "1. The 2nd respondent has lodged the complaint against the petitioner herein before the 1st respondent on 29.10.2015 and the same has been registered as a case in Crime
No.362 of 2015 for the offence under Section 294(b), 427 and 506(i) of the Indian Penal Code.
2. It is submitted that while pending the investigation of the case in Crime No.362 of 2015 the parties herein have settled their disputes amicably.
Therefore the petitioner and the 2nd Respondent jointly prays that this Hon'ble Court may be pleased to quash the F.I.R in Crime No.362/2015 on the file of the 1st Respondent and pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice."
In view of the compromise arrived at between the parties as stated above, the prosecution against all the accused in Crime No.362 of 2015 is hereby quashed. Accordingly, the Criminal Original Petition is allowed. Consequently, connected miscellaneous petition is closed.
