Seeking leave to sue the defendants/respondents, applicants/plaintiffs have come up with this application.

2. The applicants are the plaintiffs in the suit filed for declaration and partition claiming 1/4th share in the suit property.

3. The learned counsel for the applicants would submit that the "A" Schedule property is situated in Chennai while the other properties mentioned in Schedule B, C and D are situated outside the jurisdiction of this Court. Further, the second defendant is residing outside the jurisdiction of this Court and major part of cause of action arose within the jurisdiction of this court.

4. Considering the submission made by the learned counsel for the applicants and also considering the averments made in the plaint, leave is granted.
