Respondent/Complainant Criminal Appeal filed under Section 374(2) of Criminal Procedure Code r/w Section 36-B of NDPS Act, 1985, to set aside the conviction and sentence rendered by the 1st Additional Special Judge for NDPS Act, Chennai dated 17.09.2012 in C.C.No.222 of 2005 in Cr.No.54 of 2005 for offence under Section 8(c) r/w 20(b)(ii)(B) of NDPS Act and acquit the accused. For Appellant : Mr.T.S.Sasikumar For Respondent : Mr.Shanmuga Rajaswaran, Govt. Advocate (Crl.side) JUDGEMENT This Criminal Appeal has been preferred against the judgement and conviction made by the 1st Additional Special Judge for NDPS Act, Chennai in C.C.No.22 of 2005, by judgement dated 17.09.2012.

2.When the appeal is taken up for hearing, the learned counsel appearing for the appellant submits that the appellant already expired. In this regard, Mr.Shanmuga Rajeshwaran, learned Government Advocate (Crl.side) appearing for the respondent State, has produced a copy of the death certificate issued by the Chennai Corporation. According to which, the appellant V.Anbu Chezian, S/o Varatharajan, residing at No.4/12, V.O.C. Street, Meenambakkam, Chennai - 27, died on 30.02.2015. https://hcservices.ecourts.gov.in/hcservices/

3. In view of the factor that the appellant/accused is no more, recording the said submissions made by the learned counsel appearing for the appellant and the contents stated in the death certificate issued by the Chennai Corporation, this appeal is dismissed as abated.
