C.M.P.No.9958 of 2023 in C.M.A.SR.No.51011 of 2023 SUNDER MOHAN,J.

This petition has been filed to condone the delay of 229 days in filing the above captioned C.M.A.

2. Heard, the learned counsel appearing for the petitioners.

3. M/s.R.Sreevidhya, the learned counsel for the second respondent submitted that the award amount is huge and hence, the interest for the delay period may be forfeited by the appellants in the event of this Court enhancing the compensation amount. She further submitted that the first respondent remained exparte before the Tribunal; that notice to him may be dispensed with and made an endorsement in the Court bundle to that effect.

4. In view of the submission made by the learned counsel for the second respondent, notice to the first respondent is dispensed with.

5. It is seen that the claimants have given reasons for the delay in paragraph four of their affidavit. This Court is satisfied with the same, the delay is condoned. Hence, this application is ordered as prayed for.

6. Registry is directed to number the C.M.A., if it is otherwise in order and the list the same in due course.
