Second Appeal filed under Section 100 of C.P.C. against the judgment and decree dated 16.06.2012 made in A.S.No.16/2010 on the file of Sub-Court, Tirupattur, against the judgment and decree dated 30.01.2010 made in O.S.No.113/2005 on the file of District Munsif Court, Tirupattur.

J U D G M E N T

Today, a joint memo dated 22.06.2016 signed by both parties as well as their respective counsel is filed before this Court. The terms of the memo reads as follows:

1. The appellant is granted six months time for handing over vacant possession of the property subject matter of O.S.No.113 of 2005, DMC Tirupattur and the appeal will stand dismissed.

2. The respondent agrees to receive from the Appellant a sum of Rs.7,500/- as full and final settlement towards rent arrears for the suit property.

3. On receipt of the rent arrears stated supra the respondent shall give "no objection" to the appellant enabling him to get his provident fund amount from his bank account.

It is therefore prayed that this Hon'ble Court be pleased to record the Joint Memo and pass a decree in terms of the same and thus render justice.

2. Learned counsel appearing for the respective parties submit that the appeal may be disposed of in terms of the above joint memo.

3. Accordingly, the Second Appeal is disposed of in terms of the above Joint Memo which shall form part of the record and decree. No costs. Consequently, connected miscellaneous petition is closed.
