Heard learned counsel for the applicant and learned Special Government Pleader and learned counsel for the non-applicants.
Learned counsel for the first nonapplicant opposes the application on the ground that blame has been put on the advocate for not handing over the papers. The affidavit of the advocate is not filed.
It would be too much to expect an advocate to file an affidavit. Even otherwise, the applicant was not to gain by filing the appeal belatedly, as the writ petition filed by the applicant was dismissed.
Considering the reasons given in the application, the delay caused in filing the appeal is condoned. The application is allowed and disposed of.
