Complaint is regarding the encroachment of public pathway. It is the contention of the petitioner that the property in dispute belongs to the mother of the petitioner and the police cannot interfere in the civil dispute and in this regard a representation dated 28.03.2024 was given. The present Writ Petition is filed seeking to dispose of the said representation and give police protection.

2. The learned Government Advocate (Crl.Side) appearing for the respondents 1 & 2 states that since there is a criminal overt act in the complaint, the petitioner will be called for enquiry and if the police is satisfied that it is only a civil dispute, no further action will be taken on the complaint.

3. In view of the above undertaking, the petitioner and private respondents are directed to participate in the enquiry as and when called for and on such participation and co-operation, the representation shall be disposed of. Page No.2/4

4. With the above direction, this Writ Petition is disposed of. No costs.
