ORDER

(Order of the Court was made by R.SURESH KUMAR, J.) Mr.P.Gnana Sekaran, learned counsel appearing for the petitioner would submit that, as against the impugned order, already the petitioner has approached the Debts Recovery Tribunal, where it is pending, but, before the Debts Recovery Tribunal decides the issue, the entire building Page No.1 of 4

which is in question seems to have been demolished is her grievance. Therefore, some urgent steps are to be taken to decide the case pending before the Debts Recovery Tribunal, hence, parallel proceedings have been initiated by filing the present writ petition.

2. We are not accepting the said plea raised by the petitioner, because, once a statutory remedy is available, where, already the petitioner has approached the Debts Recovery Tribunal and filed necessary Securitisation Application, which is pending before the Debts Recovery Tribunal, it is for the petitioner to pursue the same in accordance with law, where, whatever the urgency raised by the petitioner could very well be brought to the notice of the Debts Recovery Tribunal.

3. Therefore, with liberty to the petitioner to approach the Debts Recovery Tribunal and pursue the matter that is already pending before it by showing urgency, this writ petition is dismissed.
