Mr.P.Sathish, learned Additional Government Pleader appearing for respondents 1 to 3 and Mr.V.J.Priyadarsana, learned Government Advocate [Crl.side] appearing for fourth respondent.
3. The petitioner is placing reliance upon the patta that stands in the name of his father in patta No.6866. The petitioner submitted an online application on 10.02.2025 to survey the subject property. Since the same was not considered, an earlier writ petition in W.P.No.6801 of 2025 was filed before this Court. The said writ petition was closed by an order dated 28.02.2025 on the ground that some time must be given to the respondents to act upon the application. Till date, since the survey has not been conducted, the petitioner has again approached this Court and filed the present writ petition.
4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the respondents 2 and 3 to act upon the online application submitted by the petitioner on 10.02.2025 and conduct the survey in the subject property based on the title document and the patta that stands in the name of the petitioner's father. This process shall be completed within a period 3/6
of four (4) weeks from the date of receipt of a copy of this order. If there are any other interested parties, such survey shall be conducted in their presence. Ultimately, if the survey is conducted and the boundaries are demarcated, the petitioner can proceed to fence the property.
