JUDGMENT
(Delivered by M.M.Sundresh, J) When the matter is taken up for hearing, learned counsel for the appellant submits that a letter sent by him to the appellant through Registered Post, informing him the date of hearing, though served, there is no response from him.
2. Learned counsel for the Respondent submits that as per the telephonic instructions received from the Respondent, the matter has been resolved between the parties out of court.
3. In such a view of the matter, we will not propose to keep the matter pending any longer, since more than 6 years had elapsed. Accordingly, we close the appeal as settled out of court, however, giving liberty to the parties, to restore it, if it is otherwise advised.
