Respondents PRAYER : Petition filed Under Article 226 of the Constitution of India praying to issue Writ of mandamus to direct the second respondent to mutate the revenue records in respect of Survey Nos.104/1 and S.No.110 measuring an extent of 22 ft. east west and 32 ft. north south and second measurement east west on the north 22 ft, on the south 0 ft, north south 32 ft.totalling 1069 sq.ft, situate at Poonthottam village, Villupuram taluk and thereby issue separate patta for the petitioner on the basis of last representation given by the petitioner on 18.2.2008.

By consent of the learned counsel on either side, the writ petition is taken up for final disposal.
2.Heard Mr.N.Suresh, learned Counsel appearing for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader appearing for the respondents.
3.The petitioners seek for issuance of writ of mandamus to direct the second respondent to mutate the revenue records in respect of Survey Nos.104/1 and S.No.110 measuring an extent of 22 ft. east west and 32 ft. north south and second measurement east west on the north 22 ft, on the south 0 ft, north south 32 ft.totalling 1069 sq.ft, situate at Poonthottam village, Villupuram taluk and thereby https://hcservices.ecourts.gov.in/hcservices/
issue separate patta for the petitioner on the basis of last representation given by the petitioner on 18.2.2008. 4.According to the petitioner, he purchased the property on 16.2.2000 and the same has been registered as Doc. No.438/2000 on the file of Joint Sub Registrar No.2, Villupuram and he is in possession and enjoyment of the property and also paying tax to the local Panchayat. The petitioner would further submit that though he has given several representations for grant of separate patt, his request has not been been considered and during 2009, the second respondent sent a notice calling upon him to appear before him along with all documents on 26.3.2009 and accordingly, the petitioner appeared before the second respondent on the said date and produced all documents. It is stated that the petitioner has also given petitions to the first respondent on 27.8.2007 and 18.2.2008, in this regard. But, till date no action has been taken. Hence, the petitioner has come forward with this writ petition for the aforementioned relief.
6.Considering the limited scope of the prayer made by the learned counsel for the petitioner, the second respondent is directed to consider the representation submitted by the petitioner dated 18.02.2008 and after hearing the petitioner and any other person if aggrieved, pass appropriate orders on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order.
