Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for a writ of Mandamus directing the respondents to confer permanent status of scavenger in the 3rd respondent branch from 2004.

O R D E R

The petitioner has come forward with this Writ Petition seeking for a direction to the respondents to confer the permanent status of scavenger, to the petitioner in the third respondent branch, on the ground that she has been working as a scavenger from the year 2004.

2. The case of the petitioner is that she has been working as a part-time scavenger on temporary basis under the third respondent from 2004. As she was not made permanent, she submitted a representation on 06.08.2012 to the second respondent. The second respondent, on the basis of his

representation sent a communication dated 14.08.2018, to the third respondent calling for comments and remarks. Thereafter, since there was no progress on the same, she has sent another representation dated 23.04.2018, to the respondents, seeking to make her as a permanent employee in the respondents bank. As the same did not evoke any response, the petitioner has come forward with this Writ Petition seeking for the aforesaid relief.

2. Heard, Mr.Hari Raj, the learned counsel for the petitioner, would submit that though he has made aforesaid prayer, he now confines his prayer seeking a direction to the third respondent to consider and pass orders on the representation of the petitioner dated 23.04.2018.

3. In view of the limited nature of relief sought for by the petitioner, this Court is of the view that no useful purpose is going to be served in seeking counter/reply affidavit from the respondents, before disposal.

4. Hence, this Court feels that this Writ Petition can be disposed of at the stage of admission itself, with a direction to the third respondent to take an informed and considered decision on the representation of the petitioner dated 23.04.2018.

5. Accordingly, the third respondent is directed to take an informed and considered decision on the representation of the petitioner dated 23.04.2018, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, if there is no other legal impediment. However, it is made clear that this order of the Court should not be treated as a mandate to dispose of such representation in any particular manner.

4. With the aforesaid direction, this Writ Petition is disposed of. No costs.
