These Civil Miscellaneous Petitions have been filed to condone the delay of 41 days in seeking to set aside the abatement on account of death of sole respondent viz., Appavoo Gounder in the above S.A.No.139 of 2015; to set aside the abatement caused due to the death of the sole respondent viz., Appavoo Gounder in the above S.A.No.139 of 2015 and to bring on record the petitioners as the legal heirs of the deceased sole respondent in the above S.A.No.139 of 2015.
2. Heard the learned counsel for the petitioners and perused the records.
3. The learned counsel for the respondent is present and has no objection to allow these petitions.
4. Having accepted the reasons stated in the affidavit, filed in support of the condone delay petition, the aforesaid delay of 41 days in seeking to set aside the abatement on account of death of sole respondent viz., Appavoo Gounder in the above S.A.No.139 of 2015 is condoned. Consequently, the petitions filed for setting aside the abatement caused due to the death of the sole respondent viz., Appavoo Gounder and to bring on record the legal heirs of the deceased sole respondent in the above S.A.No.139 of 2015 are also allowed.

5. Accordingly, these Civil Miscellaneous Petitions are allowed. Registry is directed to carry out necessary amendment in the cause title.
